1. Acceptance and eligibility
By downloading, accessing, or using NoviMuse, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the app. You must be legally capable of entering this agreement. If applicable law requires a parent or guardian’s permission, you may use NoviMuse only with that permission.
2. The NoviMuse service
NoviMuse lets you generate images from text, transform a selected photo, explore prompt examples, keep creations locally, and save or share exports. Online generation depends on network access and third-party AI services. Features, styles, limits, output sizes, providers, and availability may change over time.
3. Your prompts, images, and rights
You retain any rights you hold in prompts and source images you submit. You grant NoviMuse and its service providers a limited, worldwide right to host, transmit, reproduce, transform, and process that content only as needed to provide, secure, and support the features you request.
You are responsible for ensuring that you have all permissions and rights required to upload, transform, save, and share content. Do not upload confidential material or another person’s image where you lack required consent.
Subject to applicable law and third-party rights, you may use generated outputs for lawful personal or commercial purposes. NoviMuse cannot guarantee that an output is unique, protectable by intellectual-property law, or free from similarity to content created for others.
4. AI-generated results
AI results are probabilistic and may be inaccurate, incomplete, offensive, unexpected, or unsuitable. Images may contain distorted text, anatomy, objects, brands, people, or factual details. You must review every result before using, publishing, or relying on it.
NoviMuse does not guarantee that a prompt will be accepted or that an output will match your instructions. Requests may be blocked or removed to comply with safety requirements, law, or provider rules.
5. Acceptable use
You agree not to use NoviMuse to:
- violate any law or another person’s privacy, publicity, copyright, trademark, or other rights;
- create or distribute child sexual abuse material, sexual content involving minors, non-consensual intimate imagery, or exploitative content;
- impersonate, deceive, defraud, harass, threaten, discriminate against, or harm another person;
- create malicious, unlawful, or dangerous content or instructions;
- misrepresent an AI-generated or edited image where disclosure is required;
- probe, reverse engineer, disrupt, overload, bypass, or gain unauthorized access to the app or service;
- manipulate rewarded ads, forge reward callbacks, automate ad interactions, or obtain Creation Passes or clean exports dishonestly; or
- use the service in violation of an applicable third-party provider policy.
6. Passes, purchases, and rewarded ads
Each online generation currently uses one Creation Pass. A Clean Export Pass unlocks one eligible creation for clean export without the NoviMuse watermark. New installations begin with zero passes. NoviMuse may let you watch an optional rewarded ad to earn a Creation Pass or unlock a clean export. Reward availability may be limited by advertiser supply, consent, region, connection, cooldown, daily limits, fraud controls, or service availability.
NoviMuse may also offer consumable pass packs through Apple In-App Purchase. The quantity included in each pack is shown before purchase, and Apple displays and processes the applicable localized price, tax, payment, cancellation, and refund handling under your Apple account and Apple’s terms. Consumable passes are credited only after the App Store transaction is verified by NoviMuse. StoreKit transactions that are still pending or cannot yet be verified are not credited until verification succeeds.
Passes have no cash value, cannot be transferred, sold, redeemed for money, or moved between installations, and may be corrected where a balance resulted from error, fraud, reversal, refund, or duplicate verification. If a server-confirmed generation fails without producing an image, NoviMuse may restore the consumed Creation Pass. Except where required by law or Apple’s policies, unused consumable passes are not separately redeemable for cash.
7. Watermarked and clean exports
NoviMuse may provide a free watermarked save or share option. A clean export may require a separate rewarded ad. A verified clean-export reward applies only to the associated generated creation. Export availability is not guaranteed if the creation, local file, or online record is unavailable.
You are responsible for reviewing an export and for any destination, audience, caption, disclosure, or use you choose. Removing a NoviMuse watermark does not remove obligations to respect law, third-party rights, or required AI-content disclosures.
8. Privacy and guest-account deletion
The NoviMuse Privacy Policy explains how prompts, source images, generated images, anonymous service identifiers, reward information, and advertising data are processed. NoviMuse asks for explicit permission before sending creation content to OpenAI, and you may withdraw that permission for future requests in Settings.
You may permanently delete the automatically created guest account from Settings. Successful deletion removes the associated NoviMuse backend data, cloud-generated images, locally saved app creations, saved AI permission, and unused pass balances. Apple consumable purchases and deleted passes cannot be restored after deletion. Original photos, exported copies, device backups, and provider safety records are handled separately as explained in the Privacy Policy.
9. Third-party services
NoviMuse relies on services supplied by Apple, OpenAI, Google, Firebase, Cloudflare, advertising partners, and network providers. Their own terms and privacy notices may apply to their processing or services. NoviMuse is not responsible for third-party content, advertising, outages, or destinations you select from Apple’s share sheet.
10. NoviMuse ownership
NoviMuse’s software, interface, visual design, branding, bundled examples, and original materials are owned by Niew Yee Yaw or licensed for use and are protected by applicable law. These Terms grant you a personal, limited, non-exclusive, non-transferable, revocable right to use the app in accordance with these Terms and Apple’s applicable usage rules. No right to NoviMuse trademarks or source code is granted.
11. Availability and changes
We may update, restrict, suspend, or discontinue features for security, safety, provider, legal, compatibility, or operational reasons. NoviMuse may not work on every device, operating-system version, network, region, or with every image. We do not guarantee uninterrupted, timely, or error-free availability.
You are responsible for exporting important creations. Removing the app, deleting a creation, device loss, failed backups, or changes to online storage may cause content to become unavailable.
12. Disclaimers
To the maximum extent permitted by law, NoviMuse is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uniqueness, uninterrupted operation, or preservation of content. We do not warrant that generated outputs are lawful for every use or free of third-party claims.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.
13. Limitation of liability
To the maximum extent permitted by law, Niew Yee Yaw and NoviMuse will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of content, data, revenue, opportunity, reputation, or profits arising from the app, generated content, advertising, or inability to use the service. Where liability cannot be excluded, it is limited only to the extent permitted by applicable law.
14. Suspension or termination
We may limit or stop access to online features where reasonably necessary to address abuse, fraud, security risk, legal requirements, provider restrictions, or violation of these Terms. You may stop using NoviMuse at any time and may remove the app from your device.
15. Changes to these Terms
We may update these Terms when NoviMuse, its providers, or legal requirements change. The effective date will be updated when revised Terms are published. Continued use after updated Terms take effect means you accept them where permitted by law.
16. Applicable law
These Terms are governed by applicable law, without limiting mandatory consumer protections or any forum rights that the law of your place of residence requires to remain available.
